Tax Relief for New York State Taxpayers: IRS Debt, NYS Tax Bills, and STAR Credit Questions
New Yorkers can owe money to more than one tax collector at the same time. A federal balance with the IRS, a New York State tax bill that also covers New York City tax, and a property tax or school tax bill from your town can all land in the same month.
Republic Tax Relief helps individuals and business owners across the Empire State resolve IRS debt and balances with the New York State Department of Taxation and Finance. This page explains who is collecting from you, what each agency can do, which relief programs fit, and how our licensed team takes the calls off your plate.
Reviewed by the Republic Tax Relief resolution team, a group of enrolled agents, CPAs, and tax attorneys who have represented taxpayers before the Internal Revenue Service and state tax agencies since 2005.

How We Help New York Taxpayers With IRS and State Tax Problems
We do not have an office in New York, and we will not pretend to. What we have is a licensed team that handles IRS and state tax cases by phone, video, and secure upload every day.
- Federal authority to represent you. Once you sign IRS Form 2848, our enrolled agents, CPAs, and tax attorneys can speak to the IRS for you anywhere in the U.S.
- State authorization too. With New York’s own power of attorney form on file, we can work directly with the state tax department on your account.
- The agencies call us. After authorization, notices and calls about your case come to our team instead of your phone.
- No trip to Manhattan or Albany. You never need to visit an IRS taxpayer assistance center or a state office. We also serve Spanish-speaking clients.
Our team works from offices in Corona, CA and Laguna Hills, CA. See every state we serve on our locations page.
IRS, New York State Tax, and Property Tax: Who Collects What
The first step in any New York case is figuring out which agency sent the letter. Each one has different rules, different deadlines, and different relief programs.
| Tax | Who Collects It | Can Republic Tax Relief Resolve the Debt? |
|---|---|---|
| Federal income tax and payroll tax | Internal Revenue Service | Yes |
| State personal income tax | NYS Department of Taxation and Finance | Yes |
| New York City tax and Yonkers income tax | Collected by the state on your state return | Yes, as part of your state balance |
| Sales tax, withholding tax, and other business tax | NYS Department of Taxation and Finance | Yes |
| Real property tax and school tax | Your county, city, town, village, or school district (NYC Department of Finance for NYC residents) | No. These are local bills, and assessment appeals go through your local assessor |
That last row matters. Many people search for “tax relief” in New York when they mean help with a property tax bill. We focus on IRS and state tax debt, and we will tell you plainly if your problem belongs with a local office instead.

Match the notice to the agency first. The right relief path depends on who is collecting.
IRS Tax Relief Options for New Yorkers
Federal programs follow the same rules in Brooklyn as in Buffalo. What changes is the math, because the IRS uses local living-cost figures that run much higher downstate than upstate.
| IRS Relief Option | Who It Fits | What It Does |
|---|---|---|
| IRS installment agreement | You can afford a monthly payment | Spreads the balance out and generally stops levies |
| Offer in compromise | You cannot pay in full before the collection deadline | Settles the balance for less if the IRS accepts |
| Currently not collectible status | Your income only covers basic living costs | Pauses active collection while interest continues |
| Penalty abatement | Clean history or a serious event outside your control | Removes qualifying penalties and related interest |
| Innocent spouse relief | A spouse or former spouse caused the tax problem | Can remove your share of a joint balance |
Why Your County Changes the Answer
When the IRS reviews your finances, it allows housing costs based on where you live. A family in Manhattan or Westchester can claim far more for housing than a family in Monroe or Erie County with the same income.
That can be the difference between a high monthly payment and a realistic one, or between an offer the IRS rejects and one it accepts. Many IRS offers get turned down simply because the numbers were built on the wrong standards. Compare all of your choices in our guide to tax debt relief options and the IRS Fresh Start Program.
New York State Tax Collection: Warrants, Income Executions, and License Suspension
New York’s tax department has collection tools that surprise people who only know how the IRS works. Several of them can start without a court case.
Tax Warrants
A tax warrant works like a court judgment. Once filed with the county clerk, it becomes public record and acts as a lien on your property, which can block a refinance, a co-op board approval, or a home sale.
Income Executions on Your Wages
An income execution is New York’s version of a wage garnishment. The state first asks you to pay up to 10 percent of your gross wages yourself each payday. If you do not, your employer is ordered to take it from your paycheck until the debt is paid (NYS Tax Department: Income Executions).
Driver’s License Suspension
If you owe $10,000 or more in past-due state tax, the tax department can ask the DMV to suspend your New York driver’s license. You get a notice with 60 days to resolve the debt first, and a hardship exemption is available for some taxpayers (NYS Tax Department: Driver’s License Suspension).
- A payment plan the state accepts usually keeps your license safe
- Commercial driver’s licenses are not part of this program
- Your wages already being taken for the same debt can be a defense
Bank Levies and Refund Offsets
The state can levy your bank account and apply your state tax refund to an old balance. That includes refundable credits such as the earned income credit and the Empire State child credit, the state version of the child tax credit.
For federal collection, see our pages on wage garnishment relief, bank levy help, and federal tax lien help.
Resolving New York State Tax Debt
New York has its own relief programs. They look a little like the IRS programs, but the forms, approval standards, and timelines are different.
| New York State Option | What It Does | Things to Know |
|---|---|---|
| Installment Payment Agreement (IPA) | Lets you pay the full balance over time | Larger balances may require a financial statement. Missed payments can restart collection |
| NYS offer in compromise | Settles qualifying debt for less than the full amount | Approval standards are strict, and an accepted offer comes with conditions |
| Penalty relief | Removes state penalties when you had reasonable cause | Interest generally stays, so penalty relief is often paired with a payment plan |
| Conciliation conference or tax appeal | Challenges an assessment you believe is wrong | Strict deadlines apply, often 90 days from the notice date |
| License hardship exemption | Protects your license when losing it would cause undue hardship | Requires financial forms and proof |
If you owe both the IRS and New York, the order matters. Money you commit to one agency affects what you can offer the other, so we plan both cases together. Learn more about tax resolution for IRS and state tax debt.
IRS Penalty Abatement and Penalties and Interest
Penalties can make up a big share of what a New York taxpayer owes. The IRS failure-to-file and failure-to-pay penalties can each reach 25 percent of the unpaid tax, and interest is charged on top of both.
- First-time abatement can apply if you had no penalties in the prior three years and your returns are filed
- Reasonable cause can apply after a serious illness, a death in the family, a disaster, or other events you could not control
- Disaster postponements sometimes get missed, and the IRS charges penalties for deadlines that were extended
The IRS does not always apply penalty relief on its own. Our team reviews your transcripts and requests IRS penalty abatement in writing. See our penalty abatement guide and penalty abatement FAQs.
Property Tax, STAR Credit, and School Tax Relief for New York Homeowners
New York homeowners deal with some of the highest real estate tax bills in the country. The state offers several tax credit and exemption programs, and it helps to know how they connect to tax debt.
The STAR Program
The School Tax Relief (STAR) program lowers the school tax portion of your bill. Most newer homeowners receive it as a STAR credit, a check or direct deposit from the state, while some longtime owners keep the older STAR exemption on their bill.
- Basic STAR: for owners who live in the home, with income limits that are higher for the credit than for the exemption
- Enhanced STAR: a larger benefit for eligible homeowners age 65 and older, with lower income limits that change each year
- Eligibility is based on income from an earlier tax year, so check current limits with the state
The Real Property Tax Credit
The real property tax credit is a refundable credit for New York residents with household gross income of $18,000 or less who pay property taxes or rent. You claim it on Form IT-214, and you can file form IT-214 by itself even if you do not need to file an income tax return (NYS Tax Department: Real Property Tax Credit).
Local Property Tax Exemptions
Counties and towns also offer exemption programs for seniors, veterans, and persons with disabilities. These are handled by your local assessor, not by the state tax department or the IRS.
Where Tax Debt Comes In
These programs provide property tax relief, but they do not erase IRS or state tax debt. In fact, a past-due state balance can swallow a refund you were counting on, including refundable credits. Getting the debt on a plan first protects your future refunds and credits.
New York Income Tax Traps That Create Back Taxes
Some tax problems are much more common in New York than anywhere else. These are the ones we see most often.
- Remote work for a New York employer. Under New York’s “convenience of the employer” rule, nonresidents who work from home for a New York company may still owe New York income tax on those days.
- Moving out of state. New Yorkers who relocate to Florida or another low-tax state often face residency audits. If you kept a home here and spent too many days in the state, New York may still treat you as a resident.
- NYC tax on a resident return. New York City residents pay city income tax on the state return, so a balance due often includes three layers: federal, state, and city tax.
- Commuters from New Jersey and Connecticut. Splitting income between states can lead to underpaid withholding and credits claimed the wrong way.
- Freelance and gig income. Creative, delivery, and rideshare work often has no withholding, which leads to unfiled tax returns and growing balances.
If an audit is already open, see our IRS audit representation guide and our back tax help service.
Business Tax Relief for New York Owners
New York business owners often owe the IRS and the state at once. The most serious cases involve money the business collected from someone else and did not send in.
Federal Payroll Tax
- Unpaid payroll deposits can trigger the Trust Fund Recovery Penalty, which makes owners and officers personally liable
- Our payroll tax debt relief team works to protect the business and your personal assets
New York Sales Tax and Withholding Tax
- Owners and officers can be held personally responsible for unpaid New York sales tax
- Falling behind can put a business’s Certificate of Authority to collect sales tax at risk
- Unpaid state withholding tax raises similar personal liability issues
We work with New York restaurants, bodegas, contractors, medical practices, real estate professionals, and online sellers. See our business tax debt relief, restaurant tax resolution, construction tax resolution, real estate tax resolution, and medical practice tax resolution pages.
New York Cities and Counties We Serve
Tax problems in the five boroughs look different from tax problems in Western New York. Here is what we see most often across the state.
| Area | Counties | Tax Issues We Often Review |
|---|---|---|
| Manhattan | New York County | High-income balances, NYC tax, residency audits after a move, co-op lien problems |
| Brooklyn | Kings County | Freelance and creative income, small retail shops, sales tax |
| Queens | Queens County | Family businesses, restaurants, rideshare and delivery drivers |
| The Bronx | Bronx County | Wage executions, refund offsets, payroll tax for small employers |
| Long Island | Nassau and Suffolk Counties | Contractors, homeowners with high property and school tax, tax warrants blocking home sales |
| Westchester | Westchester County | Commuter and multi-state income, self-employed professionals |
| Buffalo | Erie County | Manufacturing and trades, retirees with surprise balances, unfiled returns |
| Rochester | Monroe County | Medical and university workers, small business payroll tax |

The Risks of Going It Alone or Using AI
New York cases mix two tax systems with different rules, plus local property tax programs that sound similar but work differently. That is where do-it-yourself plans and AI chatbots tend to break down.
Expert Insights From Our Resolution Team
- Fixing the IRS side can make the state side worse. When the IRS changes your federal return, New York expects you to report that change. Many people settle with the IRS and then get a new state bill months later.
- A state payment plan you cannot keep is worse than none. Defaulting on a New York agreement can bring back the income execution and the license suspension threat, often with less patience the second time.
- Calling the state without a plan can lock you in. Agreeing to a payment over the phone just to stop the pressure can leave nothing for the IRS, which may then levy anyway.
- AI tools confuse federal and New York programs. Chatbots often describe IRS rules as if they apply to the state, or mix up STAR, the real property tax credit, and local exemptions. A wrong answer can cost you a deadline.
- Residency questions need judgment, not a template. Whether New York can tax you after a move depends on facts like where your home, family, and work really are. Generic answers miss the details auditors look for.
- Uploading tax records to a chatbot is a privacy risk. Many public AI tools can store what you type, including your Social Security number and bank details.

New York Tax Relief FAQs
Do you have an office in New York?
No. Our offices are in Corona and Laguna Hills, California. We represent New York clients by phone, video, and secure upload, and federal and state authorization lets our licensed team handle your case from anywhere.
Can you help with New York State tax debt, or only the IRS?
Both. With your authorization, we work with the state tax department on income tax, sales tax, and withholding tax balances, including payment agreements, offers in compromise, and penalty relief.
Can New York suspend my driver’s license for unpaid taxes?
Yes, if you owe $10,000 or more in past-due state tax. The state sends a notice first, giving you 60 days to resolve the debt. An approved payment plan or a hardship exemption can usually prevent the suspension.
How much can New York take from my paycheck?
Under an income execution, the state can take up to 10 percent of your gross wages each pay period until the debt is paid. A payment agreement can often stop it.
Is New York City tax handled separately?
No. NYC residents pay city income tax on their state return, and the state collects it. An unpaid city tax balance is usually part of the same state tax bill.
Can you help lower my property tax or school tax bill?
No. Assessments and local exemptions are handled by your local assessor or the NYC Department of Finance. We resolve IRS and state tax debt, which can protect refunds and credits the state might otherwise apply to an old balance.
Will unpaid state taxes affect my refund or tax credits?
They can. New York can apply your state tax refund, including refundable credits, to past-due state tax. The IRS can also keep a federal refund to cover a federal balance.
Does New York have an offer in compromise program?
Yes. New York has its own offer in compromise program for qualifying taxpayers, with separate forms and stricter standards than many people expect. We review whether an offer makes sense before anything is filed.
Do you help Spanish-speaking clients?
Yes. Our team includes Spanish speakers who can explain your options and handle your case.
