Georgia IRS Tax Relief: When You Owe Back Taxes, We Negotiate Your IRS Debt and State Tax Debt
In Georgia, an unpaid state tax bill can become a public lien faster than most people expect. Once the Department of Revenue (DOR) records a State Tax Execution, a 20% collection fee is added and the state can levy your bank or garnish your pay.
Republic helps individuals and business owners across the Peach State resolve IRS and Georgia tax problems by phone, video and secure upload. One licensed team handles both agencies, so fixing one balance never leaves you exposed to the other.

Where our team works: We do not have an office in Georgia, and we will not post a borrowed Peachtree Street address to look local. Our licensed staff works from Southern California offices in Corona and Laguna Hills. Federal and state cases run on mail, phone and the Georgia Tax Center, so you get nationwide service with small-town attention and never sit in traffic on the Connector to see us.
How a Georgia Tax Bill Becomes a Lien
Georgia’s collection path is short and very structured. Knowing where you sit on it tells us how much time you have and which payment options are still open.
According to the Georgia DOR lien FAQ, a recorded execution makes your debt public record, attaches to property you own and gives the state 10 years from the recording date to collect. The same page says liens must generally be paid in full to be released.
That last point is the reason we push to act at Stage 1 or 2. Once the execution is recorded, the 20% fee is already part of what you owe, and selling or refinancing a home gets harder.
Owing the IRS and Georgia at the Same Time
Your state return starts from your federal adjusted gross income. When the IRS changes your federal return, the state usually sends its own bill for the same year a few months later.
The two agencies do not coordinate collections. A federal installment agreement does not stop a state garnishment, and a state plan does nothing to stop an IRS levy.
| Issue | IRS (federal) | Georgia DOR (state) |
|---|---|---|
| Lien | Notice of Federal Tax Lien | State Tax Execution, recorded with the county Superior Court clerk |
| Extra cost when it is filed | Filing does not add a percentage fee | 20% collection fee added to the balance |
| Payment plan limit | Generally up to 72 months for streamlined plans | Up to 60 months, $25 minimum per month |
| Settlement form | IRS Form 656 with Form 433-A (OIC) | Form OIC-1 with CD-14C (individuals) or CD-14B (businesses) |
| Online account | IRS Online Account | Georgia Tax Center (GTC) |
Because the rules and timelines differ, the order of your negotiations matters. We map both balances first, then fit both resolutions into one budget.
Georgia Tax Debt Collection: Levies, Garnishments and the 20% Fee
The state does not need a court judgment to collect. After the execution is on record, the DOR uses its own administrative tools.
- Bank levy: Funds in your checking or savings account are seized up to the amount due.
- Wage garnishment: Your employer must send part of each paycheck to the state.
- Notice of delinquency: A third party, such as a customer that owes your business money, is told to hold funds until the state collects them.
- Refund offsets: Federal and state refunds can be applied to what you owe.
- Private collection agencies: Some older accounts are assigned to outside collectors working for the state.
Interest and penalties continue to accrue on both balances the whole time. On the IRS side, collection follows its own notice chain before any levy. Our IRS collections defense page explains each stage, and our guide to common IRS notices decodes the letters.
Call today if any of these just happened
- Your bank froze your account after a state DOR levy
- Your HR department says a state garnishment arrived
- You received an Official Assessment and Demand for Payment
- You received IRS Letter 1058 or LT11, the final notice before a federal levy

Payment Plans and Settlement Options to Resolve Your IRS and State Tax Debt
Most callers do not need a settlement. They need time, the right monthly number and protection while the deal is being set up.
State installment agreements
The Georgia DOR payment plan page lists the basic rules. You must have filed the last five years of state returns, the plan cannot run past 60 months, and the minimum payment is $25 a month.
- Plans are requested through the Georgia Tax Center or on Form GA-9465.
- Changing an existing plan later carries an administrative fee, so the first number needs to be right.
- Accounts already under enforcement, in protest or with a pending offer may not qualify for the online option.
On the federal side, an IRS installment agreement follows different rules and can often run longer. We size both payments together so one plan does not starve the other.
Settling for less than the full amount
Both agencies can accept less than the full amount owed when paying in full is not realistic. The state program uses Form OIC-1 and reviews three grounds: doubt as to collectibility, doubt as to liability and economic hardship.
IRS offer in compromise
The IRS agrees to settle when your offer equals or beats what it could collect from your assets and future income. Learn how the OIC program works and read our offer in compromise guide.
State offer in compromise
Per the DOR offer in compromise page, collectibility and hardship offers need a full financial statement on Form CD-14C or CD-14B. A liability offer instead needs proof the assessment is wrong.
A pending state offer can block a state payment plan, so filing one too early can leave you with no protection at all. That timing call is where professional help pays for itself.
Match your situation to a starting point
| Your situation | Options to look at first |
|---|---|
| Steady income, but you can’t pay the balance at once | Federal installment plan plus a state plan of 60 months or less |
| Little equity and not enough income to pay off your tax debt | Federal offer, with a state OIC if the numbers support it |
| Financial hardship: job loss, illness or fixed income | Currently Not Collectible status federally and a hardship review with the state |
| Years of unfiled returns | Unfiled return catch-up first, since the state requires five years filed |
| Late charges from a bad year | Penalty abatement for first-time or reasonable cause relief |
| Debt created by a spouse or former spouse | Innocent spouse relief |
| A federal lien blocking a home sale or refinance | Federal lien release or withdrawal |

IRS Problems We See Across Georgia, From the Perimeter to the Coast
Tax trouble on a Buckhead trading desk looks nothing like tax trouble at a Tifton farm stand. Here is what drives the calls we get from each part of the state.
Atlanta and the Metro Counties
Atlanta, Sandy Springs, Marietta, Alpharetta, Roswell, Decatur, Lawrenceville, Duluth, Peachtree City
Film and TV crews paid on 1099s, rideshare and delivery drivers, and tech workers with stock compensation. Self-employment income with no withholding is the top cause of back taxes here.
Augusta and the CSRA
Augusta, Evans, Martinez, Grovetown, Thomson, Waynesboro
Military families, cyber contractors and workers who commute across the river into South Carolina, which creates two state returns. Masters week rentals add a twist: under 15 days a year is generally tax-free federally, but longer or repeat rentals often go unreported.
Columbus and the Chattahoochee Valley
Columbus, LaGrange, Fortson, Midland, Cataula
Soldiers and retirees from the Army post, plus residents who work across the river in Alabama. Military moves, missed state filings and mismatched residency dates are common starting points.
Savannah and the Coastal Empire
Savannah, Pooler, Richmond Hill, Rincon, Hinesville, Brunswick, St. Simons Island
Owner-operator truckers hauling from the port, hospitality workers paid partly in tips and short-term rental hosts in the historic district. Unreported 1099 and rental income shows up years later as IRS notices.
Macon and Middle Georgia
Macon, Warner Robins, Perry, Milledgeville, Dublin
Base civilians, defense contractors and small manufacturers. Retirement account withdrawals taken without withholding often produce surprise balances.
North Georgia and Athens
Athens, Gainesville, Dalton, Rome, Cartersville, Blue Ridge
Carpet and poultry suppliers, family trucking firms and mountain cabin rentals. Payroll deposits and sales tax are what slip first in a tight season.
South Georgia
Albany, Valdosta, Tifton, Thomasville, Waycross, Statesboro
Row-crop farmers, timber operators and seasonal businesses with lumpy income. A good harvest year with no estimated payments can create a tax bill that lasts for years.
Do not see your town? We help taxpayers in all 159 counties the same way, by phone, video and secure upload. Because the state runs on Eastern time, our Pacific-based team can easily take calls after your workday ends.
Business Back Taxes: Sales Tax, Withholding and Payroll
Sales tax and employee withholding are trust money. You collected it for the government, so both agencies treat it far more seriously than a late personal tax bill.
- Personal exposure: Owners and officers responsible for paying trust taxes can be held personally liable under the federal Trust Fund Recovery Penalty and under state law.
- Faster state action: For sales and withholding tax, the DOR can move to collect from third parties quickly, which can freeze customer payments.
- Unemployment tax is separate: State unemployment contributions are handled by the state Department of Labor, a different agency with its own collection process.
We work with owners in industries with thin margins and uneven cash flow:
- Construction and trades
- Medical and dental practices
- Real estate agents and investors
- E-commerce sellers
- Restaurants and food service

IRS Services Available in Georgia and Where a Professional Fits
The state has more IRS tax resources than many others. Knowing what each one does helps you decide when free help is enough and when you need representation.
| Resource | Good for | Limits |
|---|---|---|
| IRS Taxpayer Assistance Centers | Walk-in style help by appointment in Atlanta, Augusta, Columbus, Savannah and other cities | They answer questions and take payments but do not negotiate for you |
| Taxpayer Advocate Service, Atlanta | Cases stuck in IRS systems or causing serious hardship | Independent of collections but not your representative |
| Georgia Tax Center | Viewing state balances, simple payment plans, lien payoff amounts | Online plans may be blocked once enforcement starts |
| Licensed representative | Dealing directly with the IRS and DOR for you, building offers, stopping levies | Paid service, so ask for a written quote |
Every taxpayer has rights and responsibilities under the Taxpayer Bill of Rights, including the right to retain an authorized representative. Most taxpayers before the IRS who hire help do so because collections have already started or two agencies are involved.
How Our Results-Focused Approach Works
We confirm what you owe each agency before recommending anything. No program gets sold until we have seen your records.
Your files travel in a vault, not an envelope. Every tax return, bank statement and Social Security number you upload is sealed with bank-grade 256-bit encryption and handled under federal data protection standards.
Expert Insight: What Goes Wrong When Georgians Go It Alone or Ask AI
Many people start by dealing directly with the IRS or asking a chatbot. Here is what our team sees go wrong, especially with the state’s fast collection timeline.
Missing the cheap window
AI tools tend to explain IRS timelines, which are slow. The state adds a 20% fee once the execution is recorded, so a few weeks of research can cost more than professional help.
Filing an offer that removes your safety net
A pending state OIC can block a state payment plan. People who file an offer first, hoping for the best, can lose the plan that would have stopped a garnishment.
A plan you cannot keep
Picking the lowest payment the online system accepts, then defaulting, invites enforcement. State plans cannot simply be tweaked later without a fee, so the first number matters.
Sworn numbers built on guesses
Financial statements for both agencies are signed under penalty of perjury. A chatbot cannot see your transcripts, may use outdated expense standards and may not know your tax laws changed.
Also, never paste your Social Security number or bank details into a public chatbot. We compare both paths in Can AI Get a Better Settlement Than a Tax Attorney? and our tax negotiation guide.
Licensed Georgia Tax Relief Without a Local Storefront
A federal license to represent taxpayers matters more than a local street address. Enrolled agents, CPAs and attorneys can represent you anywhere in the country once you sign a power of attorney.

Green flags and red flags
- Look for: A licensed professional you can verify, such as an enrolled agent, a written fee quote and an honest answer about eligibility.
- Look for: A firm that handles your state balance too, not just the IRS.
- Avoid: Promises to settle your tax debt for less before anyone has seen your finances.
- Avoid: Large upfront fees for an “investigation” that never explains your options.
Cost depends on how many years and agencies are involved. After we review your file, you get a clear written quote before any work begins.
Results vary based on each taxpayer’s facts and finances. Past results do not guarantee a similar outcome.
Your story stays between you and your advocate. We guard every conversation and document under attorney-client and tax professional privilege standards, and share nothing without your signed permission.
Common Questions From Georgia Taxpayers
Can you help me if you do not have an office in Georgia?
Yes. Once you sign a power of attorney, our licensed team can represent you before the IRS from anywhere in the country and work with the state Department of Revenue for you. Cases are handled by mail, phone, video and secure upload.
What is a State Tax Execution in Georgia?
It is the state’s version of a tax lien. It is recorded with the Clerk of Superior Court, becomes public record, attaches to your property and allows the state to levy or garnish. A 20% collection fee is added when it is issued.
How long can Georgia collect a state tax debt?
The DOR says it has 10 years from the date a State Tax Execution is recorded to collect, and state tax liens may not be renewed. Interest continues to build during that time.
How long can a Georgia payment plan last?
Up to 60 months, with a minimum payment of $25 a month. You must have filed the last five years of state returns to qualify.
Will Georgia settle my tax debt for less than I owe?
It can. The state offer in compromise program reviews doubt as to collectibility, doubt as to liability and economic hardship. Collectibility and hardship offers need a full financial statement on Form CD-14C or CD-14B.
Does an IRS payment plan cover what I owe Georgia?
No. The IRS and the state DOR are separate agencies. Each balance needs its own agreement, and both should be planned together so the payments fit your budget.
Can a business owner be personally liable for unpaid sales or payroll taxes?
Yes. Owners and officers responsible for trust taxes can be held personally liable by both the IRS and the state, even after the business closes.
What should I have ready for my free consultation?
Any IRS or state letters, your latest tax return and a rough idea of your monthly income and bills. If you do not have everything, call anyway. We can pull your records once you authorize us.
