IRS Tax Relief in California: IRS & FTB Back Tax Help

IRS and California Tax Relief for Individuals and Businesses, Including Disaster Victims

Owing taxes in California often means owing two governments at once. The IRS wants its share, and the California Franchise Tax Board wants its share too. Business owners may also hear from the CDTFA about sales tax or the EDD about payroll tax.

Republic Tax Relief is a California firm with offices in Corona and Laguna Hills. We help individuals and businesses across the state resolve federal and state tax debt, and this guide explains how relief works with each agency, what happens after a wildfire or storm, and how our licensed team can take the pressure off you.

IRS vs. California Tax Agencies: Who Are You Dealing With?

The first step in any California case is figuring out who wants the money. Each agency has its own rules, its own collection tools, and its own clock.

Agency What It Collects Who Usually Owes Collection Window
IRS Federal income tax, federal payroll tax, penalties Individuals and businesses Generally 10 years from assessment
Franchise Tax Board (FTB) State income tax, corporate and LLC franchise tax Individuals and businesses Generally 20 years
CDTFA Sales and use tax, certain special taxes Retailers, restaurants, e-commerce sellers Varies by tax and case
EDD State payroll taxes and withholding Employers Varies by tax and case

That 20-year window is the detail most people miss. The FTB generally has 20 years to collect unpaid state tax, and some later charges and fees can restart that period (FTB: Statute of Limitations on Collection Actions). Waiting out a California tax debt rarely works.

IRS Tax Relief Options for Californians

Federal relief programs follow the same rules in California as in any other state. What changes is how high California living costs, home equity, and income are counted when the IRS looks at what you can afford.

Relief Option Best For What It Does
Payment plans People who can pay over time Monthly installments that stop most levies
Offer in compromise People who cannot pay before the collection deadline Settles the tax balance for less, if accepted
Currently Not Collectible No money left after basic living costs Pauses active collection
Penalty relief Clean history or a serious life event Removes certain IRS penalties
Innocent spouse relief Spouses harmed by a partner’s tax errors Removes your share of a joint liability

Many of these options became easier to reach under the IRS Fresh Start initiative. For a full comparison, see our guide to tax debt relief options.

California Franchise Tax Board Debt Help

Many Californians fix their IRS problem and then find out the state is still waiting. The FTB often learns about federal changes from the IRS and follows up with its own bill, sometimes years later.

How the FTB Collects

  • Earnings withholding orders that take part of each paycheck
  • Bank levies that pull money from checking and savings accounts
  • State tax liens that can show up when you sell or refinance a home
  • License consequences for some of the largest delinquent balances, which can affect professional and driver’s licenses

FTB Relief Options We Review

  • Installment agreements that spread a balance over monthly payments
  • State offer in compromise, a separate program from the IRS version
  • One-time penalty abatement for qualifying individuals who are current on filing and have no prior abatement (FTB: One-Time Penalty Abatement)
  • Reasonable cause relief when a serious event kept you from filing or paying on time
  • Collection holds while a hardship or account error is being reviewed

An IRS settlement does not settle your state tax. We plan both cases together so a deal with one agency does not create trouble with the other.

IRS and California Disaster Relief for Wildfire, Storm, and Flood Victims

Wildfires, winter storms, flooding, and mudslides have all led to tax relief for California taxpayers. When the IRS announces tax relief for victims of a federally declared disaster, the Franchise Tax Board often follows with matching state relief.

How Disaster Relief Usually Works

  • It is usually automatic. Taxpayers whose IRS address of record is in the covered disaster area generally get more time without asking (IRS: Tax Relief in Disaster Situations).
  • It covers many deadlines. Relief often postpones individual income tax returns, business tax returns, quarterly estimated tax payments, and payroll and excise tax deposits that fall inside the relief window.
  • State relief can differ. The FTB generally conforms to IRS postponements, but its announcement can come later, and the dates may not match exactly.
  • Records count too. If you live outside the disaster area but your records or your tax preparer are inside it, you may need to contact the IRS to qualify for relief.
  • Losses may help. A disaster loss may be claimed on the current or prior year’s tax return, which can mean a faster refund.

What Disaster Relief Does Not Do

Disaster relief moves the tax deadline. It does not reduce what you owe or erase back taxes from earlier years.

  • Balances owed before the disaster still need a resolution plan
  • Penalty relief only covers deadlines inside the relief window
  • Missing the new postponed date can trigger penalties like any other year

After the Los Angeles County wildfires, for example, the IRS and California both pushed many filing and payment deadlines to October 15. We often see clients who were already behind before a fire or flood. We sort out which tax years and deadlines the relief actually covers, then ask the IRS or FTB to remove any penalty that should never have been charged.

Back Taxes, Unfiled Returns, and Audits in California

Back taxes in California often start with income that had little or no withholding. Gig work, 1099 contracts, vested stock, and rental income are common sources.

  • Unfiled returns come first. Neither the IRS nor the FTB will usually approve a plan or settlement until required returns are filed. Our unfiled tax returns team handles that step.
  • Estimated returns cost you money. If you do not file, either agency may estimate your tax without the deductions you are owed.
  • Federal changes travel to the state. An IRS audit adjustment usually means a California adjustment too. We handle both through IRS audit representation and state follow-up.

Stopping a Levy, Garnishment, or Lien in California

A levy feels like an emergency because it is one. In a high-cost state, losing a paycheck or a bank balance can put rent and car payments at risk the same week.

To stop or release a levy, we typically:

  • File authorization so the IRS or FTB deals with us right away
  • Show economic hardship when a levy blocks basic living costs
  • Put a collection alternative in place, such as a payment plan
  • Check whether a hearing or appeal deadline is still open
  • Review federal and state liens for release, withdrawal, or subordination

California is also a community property state. That can affect how the IRS and FTB view household income and shared assets when only one spouse owes.

Business Tax Debt Relief in California

California business owners can owe four agencies at once: the IRS, FTB, CDTFA, and EDD. Unpaid payroll tax and unpaid sales tax are the most dangerous, because both can become personal debt for owners and officers.

We help California business owners with:

  • Payroll tax debt relief for IRS and EDD balances
  • CDTFA sales tax audits, assessments, and payment plans
  • LLC and corporate franchise tax balances with the FTB
  • Business IRS audits and state audit follow-up
  • In-business payment plans that keep your doors open

We also support industries common across California, including construction, real estate, medical practices, e-commerce, and restaurants. Explore our full business tax debt relief services.

The Risks of Going It Alone or Using AI

California tax problems involve more agencies, longer collection windows, and more disaster deadlines than most states. That is where do-it-yourself plans and AI chatbots tend to fall apart.

Expert Insights From Our Resolution Team

  • Fixing the IRS side can wake up the FTB. An IRS adjustment or amended return usually reaches the state. People who settle federally and stop there often get a state bill later, with years of added interest.
  • The 20-year clock changes the math. Strategies built on waiting out the IRS collection period do not carry over to California, and some fees can restart the state clock.
  • Disaster relief has two announcements, not one. Many taxpayers assume the IRS date also applies to their state return. When the FTB announcement is later or different, a missed state deadline can still create penalties.
  • The wrong payment order can sink a business. Owners often pay the IRS first while CDTFA sales tax or EDD payroll tax goes unpaid. Losing a seller’s permit can stop income faster than any levy.
  • AI tools mix up agencies and dates. Chatbots often blend IRS and FTB rules or repeat an old disaster announcement as if it were current. One wrong date can cost you penalties.
  • Uploading tax records to a chatbot is a privacy risk. Many public AI tools may store what you type, including Social Security numbers and bank details.

California Tax Relief FAQs

Do you have an office in California?

Yes. We have offices in Corona and Laguna Hills. You can meet with us by appointment or work with us by phone, video, and secure upload from anywhere in the state.

Can you help with both the IRS and the Franchise Tax Board?

Yes. With your authorization, we represent you before the IRS and the California Franchise Tax Board, and we plan both cases together so one agreement does not hurt the other.

How long can the FTB collect California tax debt?

The FTB generally has 20 years to collect, and certain later charges can restart that period. The IRS generally has 10 years from assessment.

How do I know if IRS and California disaster relief applies to me?

The IRS lists current disaster relief by state on its disaster relief page, and the FTB posts its own announcements. If your address of record is in a covered county, relief is usually automatic, but state dates can differ from federal dates.

Does disaster relief forgive my tax debt?

No. Disaster relief postpones filing and payment deadlines. It does not erase taxes owed before the disaster, and penalties can apply again once the postponed date passes.

Can the FTB garnish my wages?

Yes. The FTB can send an earnings withholding order to your employer. A payment plan, hardship review, or other agreement can often stop or reduce it.

Can I settle California tax debt for less than I owe?

Possibly. Both the IRS and the FTB have offer in compromise programs, and each reviews your income, expenses, and assets. A professional review before you apply can save time and money.

Do you help Spanish-speaking clients?

Yes. Our team includes Spanish speakers who can explain your options and handle your case.
