Arkansas IRS Tax Relief: Resolve Tax Debt and Back Taxes With the IRS and the State
Most Arkansans who owe back taxes owe two collectors, not one. The IRS wants its federal balance, and the Arkansas Department of Finance and Administration (DFA) can record a Certificate of Indebtedness that works like a court judgment against your property.
Republic Tax Relief helps Arkansas individuals and businesses settle, pause or restructure IRS debt and state tax balances by phone, video and secure upload. You get one licensed team handling both agencies, so a deal with one does not trigger trouble with the other.

Where our team works: We do not have an office in Arkansas, and we will not list a fake address to look local. Our licensed staff works from Southern California offices in Corona and Laguna Hills. IRS and DFA cases run on mail, phone and online systems, so you never need to drive to Little Rock or anywhere else.
Arkansas Tax Debt Usually Means Two Agencies, Two Sets of Rules
Arkansas has its own individual income tax, a state sales tax and withholding rules for employers. When you fall behind on paying taxes to the IRS, you are often behind on Arkansas state tax for the same years, because both returns draw on the same income.
The Internal Revenue Service and the DFA Revenue Division run separate collection systems. They have different notices, different payment plan rules and different settlement standards. Fixing one set of tax liabilities does not pause the other.
| Issue | IRS (federal) | Arkansas DFA (state) |
|---|---|---|
| Lien | Notice of Federal Tax Lien | Certificate of Indebtedness filed with the county circuit clerk |
| Settlement | Offer in compromise based on ability to pay | Offer in compromise for insolvent taxpayers only |
| Monthly plan | Installment agreement, up to 72 months on streamlined plans | Payment plan agreement, reviewed case by case |
| Hardship pause | Currently Not Collectible status | No matching formal program |
| If an offer is rejected | You can appeal | No formal appeal rights |
Because the rules differ, the order you approach each agency matters. Our job is to line them up so your federal plan and your state plan fit the same budget.
How Arkansas Collects Back Taxes: The Certificate of Indebtedness
When owed taxes go unpaid in Arkansas, the DFA can file a Certificate of Indebtedness with the circuit clerk in your county. Once recorded, it acts like a court judgment and becomes a lien on real and personal property in that county.
From there, the state can move to garnish wages, seize property through a writ of execution or cancel a business’s sales tax permit. For a store, restaurant or contractor, losing that permit can shut the doors faster than any IRS action.
Call us right away if you receive any of these
- IRS CP504: Notice of intent to levy certain assets, including state tax refunds
- IRS LT11 or Letter 1058: Final notice before levy on wages, bank accounts and other property
- IRS Letter 3172: A Notice of Federal Tax Lien has been filed
- A DFA proposed assessment or demand for payment with a short window to respond
- Word that a Certificate of Indebtedness was recorded with your circuit clerk
- A DFA warning about your sales tax permit or business closure
These notices carry short deadlines, and some appeal rights expire if you wait. Our IRS collections defense page explains each federal stage, and our guide to common IRS notices decodes the rest. For federal liens, see tax lien help.
Offer in Compromise Eligibility: IRS vs. the Arkansas DFA
Both agencies let some taxpayers settle tax debt for less than the full amount. That is where the similarity ends, and mixing up the two programs is one of the most common mistakes we see.
The IRS offer in compromise
The IRS looks at your reasonable collection potential. In plain terms, that is your net realizable equity in assets plus a set number of months of future disposable income. If that figure is lower than the amount owed, an offer may let you owe less.
- Forms: Form 656 plus a detailed financial statement, with an application fee unless you meet low-income guidelines
- Lump sum cash offer: 20% sent with the application, the rest paid in five or fewer payments after acceptance
- Periodic payment offer: Paid in monthly amounts within 24 months, with payments continuing while the IRS reviews it
- Ground rules: All required tax returns filed, current on estimated tax payments, and not in an open bankruptcy court proceeding
- Refund rule: The IRS keeps any tax refund due for the year your offer is accepted
The IRS explains these requirements on its offer in compromise page. Learn more about how the OIC program works.
The Arkansas offer in compromise
The DFA Revenue Division runs its own program under state tax law, and it is much narrower. According to the Arkansas DFA, you must be insolvent, which means your debts exceed the market value of your assets or you cannot pay debts as they come due.
- The debt must be final. You cannot still be disputing it or have appeal time left.
- Every Arkansas return must be filed before the state will consider your offer.
- Federal financial forms such as the 433-A or 433-F are part of the package.
- Missing documents end the review. The DFA withdraws incomplete applications.
- Acceptance is discretionary, and a rejection has no formal appeal.
Since a rejected Arkansas offer cannot be appealed, the first submission needs to be right. We build the state offer from the same verified numbers we use with the IRS, so both stories match.
Payment Plan Options and Lower Payments for Arkansas Taxpayers
If you cannot pay your tax bill at once but can keep making payments, an installment agreement is often the fastest way to stop collection on IRS tax debt. The trick is setting a monthly payment you can keep through a slow season, not just your best month.
IRS installment agreements
Smaller balances can often qualify for a streamlined plan of up to 72 months without full financial disclosure. Larger balances usually need a Form 433-F or similar statement. Being enrolled in direct debit lowers setup costs and reduces the chance of a missed payment.
Arkansas payment plan agreements
The DFA reviews each request on its own and is not required to approve it. Interest keeps running, and the state generally files a Certificate of Indebtedness during the plan. Some smaller individual income tax balances paid electronically within 12 months may avoid a lien.
When both agencies want a monthly payment, the total has to fit one household budget. The IRS uses its payment plan rules and national expense standards, while the state looks at your full financial situation. We present the numbers so neither plan starves the other. See our guide to IRS payment plans.
Hardship, Penalty Abatement and Penalty Relief in Arkansas
Sometimes the honest answer is that you cannot pay anything right now. Other times, the tax itself is manageable but the penalties and interest have doubled it.
- Financial hardship: The IRS can place your account in Currently Not Collectible status when basic living expenses use up your income. Arkansas does not have a matching formal program, so state hardship cases often need a different approach.
- IRS penalty abatement: First-time abatement or reasonable cause, such as a serious illness, a tornado or a death in the family, can remove qualifying penalties. See IRS penalty abatement.
- Arkansas penalty relief: The state is generally stricter about waiving interest and penalties, but a written waiver request or a request inside an offer can sometimes reduce them.
- Innocent spouse relief: If a current or former spouse caused the federal tax debt, innocent spouse relief may separate you from it.
Penalty relief rarely makes headlines, but it can shrink the remaining tax balance enough to make a payment plan affordable.
Owe Back Taxes With Unfiled Years? File Your Taxes Before Any Deal
Neither the IRS nor the DFA will settle or set up most plans while returns are missing. Unfiled years also let the IRS create a substitute return for you, usually with no deductions and a much higher balance.
We prepare the missing federal and Arkansas returns together so the income matches on both. This is also when we look for refunds you may still be able to claim and expenses that lower the amount you owe. See our unfiled tax returns services.
Finding the Best Tax Relief Option for the Amount You Owe
There is no single best tax program for everyone. The right fit depends on your income, your expenses, your asset equity and which agency you owe.
| Your situation | Options to look at first |
|---|---|
| You can’t pay the full balance and have little equity | IRS offer in compromise, plus an Arkansas offer if you are insolvent |
| Steady income, balance too big to pay at once | Installment agreement with the IRS and a DFA payment plan |
| Out of work, retired on a fixed income or disabled | Currently Not Collectible status |
| Penalties larger than the original tax | Penalty abatement and a state waiver request |
| Paycheck or bank account already being taken | Wage garnishment relief or bank levy help |
| Business behind on payroll or sales tax | Payroll tax debt relief and business tax resolution |
Each of these tax relief programs is designed for a different situation and has its own eligibility rules, and a few are often oversold online. For a wider look at debt relief options, read our guide to tax debt relief options and the IRS Fresh Start program.

Arkansas Industries and the IRS Problems We See Most
Arkansas work is often seasonal, contract-based or tied to one large customer. Those patterns create tax debt in ways that look different from a typical paycheck job.
Contract poultry growers
Growers carry big loans on houses and equipment, and settlement checks swing with each flock. The IRS may count equity in that equipment when it weighs an offer, so values need careful support.
Delta row-crop farmers
Rice, soybean and cotton operations can show a strong year followed by a loss. A plan built on one good harvest often defaults after a flood or a price drop.
Owner-operator truckers
Northwest Arkansas and Fort Smith are freight hubs. Leased-on drivers paid on a 1099 often skip estimated taxes, then face self-employment tax plus heavy vehicle use tax problems.
Retail suppliers and consultants
The vendor community around Bentonville and Rogers includes many small firms and independent reps. Fast growth can outrun payroll deposits and quarterly payments.
Contractors and tradespeople
Storm rebuilding and new construction keep crews busy, but subcontractors often run into payroll and sales tax trouble. See our construction tax resolution services.
Border-city workers
People in Texarkana, West Memphis and Fort Smith often live in one state and work in another. Texarkana even has a special Arkansas income tax exemption, which makes it easy to file the wrong way.
Medical practices, restaurants and online sellers also call us often. Learn more about tax resolution for medical professionals, e-commerce businesses and small business tax relief.
Serving Arkansas From the Ozarks to the Delta
A tax problem in a Bentonville office park looks different from one on a Phillips County farm. Here is what we see across the state.
Little Rock and Central Arkansas
Little Rock, North Little Rock, Conway, Benton, Bryant, Sherwood, Jacksonville, Cabot, Maumelle
State government, hospitals and a large base of small businesses. Many calls involve a federal levy and a DFA assessment arriving within weeks of each other.
Fayetteville and Northwest Arkansas
Fayetteville, Springdale, Rogers, Bentonville, Bella Vista, Lowell, Siloam Springs
Retail suppliers, logistics, poultry and a fast-growing self-employed workforce. Rapid income growth often leaves estimated payments behind.
Fort Smith and the River Valley
Fort Smith, Van Buren, Russellville, Clarksville, Ozark
Manufacturing, trucking and workers who cross into Oklahoma. Two-state income and freight 1099s are common threads.
Jonesboro, Northeast Arkansas and the Delta
Jonesboro, Paragould, Blytheville, West Memphis, Forrest City, Helena-West Helena, Stuttgart
Row-crop farming, agricultural services and Memphis commuters. Farm equipment and land equity can shape which options fit.
South and Southwest Arkansas
Texarkana, Pine Bluff, El Dorado, Magnolia, Camden, Hope, Monticello
Timber, oil field services and border-city households. Texarkana residents need special care with state filing before any deal is negotiated.
Hot Springs, the Ouachitas and North Central
Hot Springs, Hot Springs Village, Malvern, Arkadelphia, Searcy, Batesville, Mountain Home, Harrison
Tourism businesses, retirees and rural self-employed workers. Retirees on fixed income often qualify for hardship options they never knew existed.
Wherever you live, the work happens the same way: by phone, video and secure upload, with no drive to an office required.
How Our Arkansas Tax Resolution Process Works
We confirm what you owe to each agency first, then match you to the option you actually qualify for. No program gets sold before we see your file.

Your documents travel locked. Every return, Social Security number and bank statement you upload is sealed with bank-grade 256-bit encryption, handled under federal data protection standards from upload to case close.
Expert Insight: The Hidden Risks of Handling IRS and Arkansas Debt Alone or With AI
Many Arkansans try calling the IRS themselves or ask a chatbot what to do. Here is what our resolution team sees go wrong.
Federal rules applied to a state offer
AI tools often describe the IRS offer formula and assume Arkansas works the same way. It does not, and since a rejected state offer has no appeal, a wrong first try can close that door.
Fixing the IRS while the state files a lien
People set up an IRS plan, feel relieved and ignore the DFA. Months later, a Certificate of Indebtedness shows up at the circuit clerk and blocks a refinance or land sale.
Overstating asset equity
Farm land, poultry houses, trucks and timber are hard to value. Plugging in a retail price instead of a quick-sale value can inflate your offer by thousands.
Chasing “IRS grants”
Online ads and some chatbot answers mention grants that pay off tax debt. No such federal grant exists, and those ads often lead to fee-first companies or identity theft.
An AI tool cannot see your transcript, sign a power of attorney or speak with a revenue officer for you. Pasting your Social Security number into a public chatbot is a privacy risk too. We compare both paths in Can AI Get a Better Settlement Than a Tax Attorney? and our tax settlement guide.

Arkansas Tax Relief: Common Questions
Does Arkansas have its own offer in compromise program?
Yes. The Arkansas DFA Revenue Division can settle state tax debt for less than the full amount, but only for insolvent taxpayers with final, undisputed debts and all returns filed. Acceptance is discretionary, and a rejection cannot be formally appealed.
What is an Arkansas Certificate of Indebtedness?
It is the state’s version of a tax lien. The DFA files it with the circuit clerk in your county, where it acts like a court judgment against your property and allows further collection such as garnishment.
If I settle with the IRS, does my Arkansas tax debt go away?
No. The IRS and the Arkansas DFA are separate agencies, and an IRS settlement or payment plan does not cover state taxes owed. Each balance needs its own resolution, ideally planned together.
Are there IRS grants to pay off tax debt?
No. The IRS does not offer grants to pay tax balances. Real relief comes through programs such as an offer in compromise, installment agreements, Currently Not Collectible status and penalty abatement.
Can you help me if you do not have an office in Arkansas?
Yes. Once you sign a power of attorney, our licensed team can represent you before the IRS from any state and work with the Arkansas DFA on your behalf. Most cases are handled by mail, phone and secure upload.
How long can an IRS payment plan last?
Streamlined IRS installment agreements can run up to 72 months for qualifying balances. Larger balances may need a financial statement, and Arkansas reviews its own payment plans case by case.
I live in Texarkana or West Memphis and work across the state line. Can you help?
Yes. Border-city households often have income taxed by two states or special exemptions, such as the Texarkana exemption. We review how your income was reported before negotiating any federal or state balance.
Can the IRS take my tax refund while I owe back taxes?
Yes. The IRS generally applies federal refunds to unpaid balances, and if your offer is accepted, it keeps the refund for that year. Planning the timing around tax season can help you avoid surprises.
